Ohio Parenting Time Law: What the Court Considers

Ohio statute uses “parenting time” for the schedule a non-residential parent has with their child. The term “visitation” in Ohio law typically refers to rights sought by non-parents, such as grandparents. Under ORC 3109.051, a court must enter a parenting time order that is just and reasonable unless it determines that parenting time wouldn’t serve the child’s best interest.

ORC 3109.051(D) sets out 16 factors the court must consider when building that schedule. Key among them are the prior relationship between the child and each parent, geographic distance between homes, the child’s age and adjustment to school and community, each parent’s willingness to facilitate the other parent’s parenting time, and the mental and physical health of all parties. Ohio law also requires equal treatment of mothers and fathers; no maternal presumption exists under ORC 3109.03.

Hamilton County Standard Parenting Orders

Hamilton County courts use Standard Parenting Orders as a baseline when parents haven’t agreed on a schedule. Through Shawn M. Hamilton County Domestic Relations Court issued a revised Standard Parenting Order in April 2024 that added equal parenting time options for school-age children, including week-on/week-off, 2-2-3, and 2-2-5 rotating schedules. The Hamilton County Juvenile Court’s guidelines use a 2-2-5 schedule as the default for school-age children. Schedules differ for children under age six. If both parents agree on a different arrangement, the court can incorporate that agreement into the order.

Modifying or Enforcing a Parenting Time Order

Parenting time orders aren’t permanent. When circumstances change in a meaningful way, such as a parent relocating, a change in school enrollment, or a significant shift in a work schedule, either parent may ask the court to modify the existing schedule. The standard is whether there’s a change in circumstances that affects the child’s best interest.

When a residential parent refuses to follow an existing order, the non-residential parent can file a motion for contempt in the issuing court. Courts responding to contempt may award compensatory parenting time, order the violating parent to pay court costs and attorney fees, and may impose additional penalties, including fines or, in repeated cases, jail time. Documented interference with parenting time also becomes a factor in any future modification request under ORC 3109.04(F)(1).

One point many parents misunderstand: child support and parenting time are legally independent in Ohio. A parent can’t withhold parenting time because the other parent is behind on support, and stopping support payments isn’t a legal response to denied parenting time. Both issues have their own remedies under Ohio law.

Grandparent & Third-Party Visitation Rights in Ohio

When a child’s parents divorce or separate, grandparents and other relatives may have grounds to seek companionship or visitation rights of their own. Under ORC 3109.051(B), a grandparent, relative, or other person with an interest in the child’s welfare may petition the court during or after a divorce, dissolution, legal separation, or annulment proceeding. The best interest standard applies.

Grandparents may also petition under ORC 3109.11 when a parent has died. The U.S. Supreme Court’s ruling in Troxel v. Granville limits the reach of grandparent visitation claims against intact two-parent families, but divorce or a parent’s death reopens the question. Stepparents, aunts, uncles, and others who have consistently served a caregiving role may also petition under ORC 3109.051(B), provided the court finds they have an interest in the child’s welfare and that visitation serves the child’s best interest.
