Ohio’s Three Statutory Pathways for Grandparent Companionship Rights

Ohio law creates specific circumstances under which grandparents may seek court-ordered companionship rights. Grandparents in intact families, where both parents are married and living, don’t have a statutory right to petition for court-ordered visitation. For everyone else, eligibility depends on which of three statutes applies to your situation.

• ORC 3109.051 (Divorce or Dissolution Context): When the child’s parents are divorcing, have dissolved their marriage, are legally separated, have had their marriage annulled, or are involved in a child support proceeding, grandparents may file a motion for companionship rights within that existing case.
• ORC 3109.11 (Deceased Parent Context): When a parent of the child has died, grandparents and other relatives of the deceased parent may file a complaint for reasonable companionship rights. Remarriage or adoption by the surviving parent does not automatically eliminate a grandparent’s right to seek or maintain court-ordered visitation under this statute.
• ORC 3109.12 (Unmarried Parents Context): When the child’s parents were never married, maternal grandparents may petition for companionship rights. Paternal grandparents may do so only if paternity has been legally established.

Petitions are filed in the county where the child resides, which may differ from where the grandparent lives. For families in Hamilton County, the Court of Common Pleas handles these matters through either the Domestic Relations or Juvenile division, depending on the case type.

How Ohio Courts Decide Grandparent Companionship Cases

Qualifying under one of the three statutes opens the door to seek companionship rights. It doesn’t guarantee an order. Ohio courts apply the best-interest-of-the-child standard in every grandparent visitation and custody decision, weighing factors that include:

• The prior relationship between the grandparent and the child
• The child’s existing relationships with parents, siblings, and other relatives
• The geographic distance between grandparent and child
• The physical and mental health of all parties involved
• The child’s own wishes, if the child is of sufficient age and maturity
• Any history of abuse, neglect, or domestic violence

Grandparents seeking custody rather than companionship rights face a higher burden. The court must find that placement with a parent isn’t in the child’s best interest, which generally requires evidence of parental unfitness or an inability to provide adequate care. In all cases, grandparents bear the burden of presenting compelling evidence that the arrangement they’re seeking serves the child’s best interests without unduly interfering with the parent-child relationship.
