Separation Agreement

Separation Agreements in Cincinnati

Clear Terms for Property, Support & Parenting

A separation agreement puts spouses’ decisions about finances, property, support, and parenting into a formal written document. At Goldberg Evans, we help Cincinnati couples negotiate and prepare terms suited to their family circumstances, whether they’re pursuing a legal separation or an agreed dissolution of marriage.

Under Ohio law, a separation agreement can serve different purposes. It may govern a formal legal separation, in which the spouses remain married, or accompany a petition for dissolution of marriage. A dissolution ends the marriage and requires both spouses to agree on every necessary term.

A divorce follows a different path when spouses have contested issues that may require a court to decide. Because these options serve different purposes and involve different court processes, we explain the available paths before preparing an agreement.

What an Ohio Separation Agreement Can Address

A written agreement creates a defined framework for financial and parenting responsibilities. It can establish how spouses will manage those responsibilities while remaining legally married or set the complete terms for a dissolution.

For a dissolution, Ohio law requires the separation agreement to address the division of all property and spousal support. The agreement can also allocate liabilities, including marital debt. When spouses have minor children, they may include a shared parenting plan filed with the dissolution petition.

Common subjects addressed in an agreement include:

  • Division of marital property and other identified assets
  • Allocation of debts and continuing financial obligations
  • Spousal support when the spouses agree it’s appropriate
  • Parenting arrangements for children

What Our Clients Have to Say About Working with Us.

Negotiated Solutions with Direct Attorney Involvement

Trista P. Goldberg and Shawn M. Evans have practiced family law exclusively since 2009. They founded Goldberg Evans in 2019 after gaining experience at larger firms, creating a boutique practice centered on direct attorney involvement and individualized guidance.

Both founding partners are trained in the collaborative divorce process, a structured method in which spouses and their attorneys work toward an agreement without asking a judge to resolve disputed terms. Trista is also a trained Collaborative Law Attorney and Mediator. Those skills support creative negotiations based on the family’s property, support, and parenting circumstances.

Our approach begins with understanding what matters to each client. We build a trusting attorney-client relationship so our advice and negotiation strategy reflect the person, the family, and the decisions ahead.

How Our Attorneys Prepare Separation Agreements

When you contact us, you speak directly with an attorney rather than a call center or paralegal buffer. We review the issues to be resolved, discuss your priorities, and explain how a proposed agreement relates to the legal process you’re considering.

Depending on the circumstances, available processes may include mediation, collaborative divorce, dissolution, or litigation. Mediation can address parenting plans, property and debt division, and spousal support. Collaborative divorce offers another negotiated path for spouses committed to reaching terms outside court litigation.

When Spouses Don’t Agree on Every Term

A dissolution depends on complete agreement. If spouses can’t resolve all required terms, they can’t complete a dissolution based on an agreed separation agreement. We explain other paths forward and evaluate which process fits the contested issues.

At any time before the dissolution is granted, either spouse may move to convert the case to a divorce if the parties no longer agree. The spouses may instead continue negotiating, and they can file an amended separation agreement before or during the hearing if they reach revised terms.

Shawn M. Evans brings extensive trial experience to cases that can’t be resolved by agreement.
